{"id":34300,"date":"2020-08-09T16:23:56","date_gmt":"2020-08-09T14:23:56","guid":{"rendered":"https:\/\/www.monaco-tribune.com\/2020\/08\/after-legal-clash-in-monaco-yves-bouvier-faces-tax-evasion-charges-in-switzerland\/"},"modified":"2020-08-10T18:24:39","modified_gmt":"2020-08-10T16:24:39","slug":"after-legal-clash-in-monaco-yves-bouvier-faces-tax-evasion-charges-in-switzerland","status":"publish","type":"post","link":"https:\/\/www.monaco-tribune.com\/en\/2020\/08\/after-legal-clash-in-monaco-yves-bouvier-faces-tax-evasion-charges-in-switzerland\/","title":{"rendered":"After legal clash in Monaco, Yves Bouvier faces tax evasion charges in Switzerland"},"content":{"rendered":"\n<p><strong>Fresh on the heels of <a href=\"https:\/\/www.monaco-tribune.com\/en\/2020\/07\/rybolovlev-vs-bouvier-case-dismissed-in-monaco\/\">claiming<\/a> \u201ca total and definitive victory\u201d regarding the charges of fraud and money laundering that he faced in Monaco, art dealer Yves Bouvier is facing accusations of tax avoidance in his native Switzerland. <\/strong><\/p>\n\n\n\n<p>Documents <a href=\"https:\/\/www.theartnewspaper.com\/news\/yves-bouvier-tax-evasion\">unsealed<\/a> this week by Switzerland\u2019s Federal Criminal Court revealed that Swiss authorities believe Bouvier may have evaded taxes on CHF 330 million of profits.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Art dealer under investigation since 2017 <\/h2>\n\n\n\n<p>The Swiss Federal Tax Administration has been investigating Bouvier\u2019s finances since 2017, when they estimated that the art dealer and two of his offshore companies might owe CHF 165 million in back taxes. The CHF 330 million in profits they now believe Bouvier owes taxes on correspond to the same transactions which were the subject of the criminal charges against Bouvier in Monaco and other jurisdictions. The Monaco charges were <a href=\"https:\/\/news.artnet.com\/art-world\/yves-bouvier-lawsuit-dismissed-monaco-rybolovlev-1893375\">dropped<\/a> by the Monaco Court of Revision in early July after an appellate judge in the principality found that Monaco\u2019s investigations into Bouvier had been carried out in \u201ca biased and unfair way\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Revenue stemming from artworks sales to AS Monaco owner <\/h2>\n\n\n\n<p>Between 2003 and 2014, Yves Bouvier sold 38 artworks to AS Monaco owner Dmitry Rybolovlev for CHF 2 billion. Swiss authorities now <a href=\"https:\/\/news.artnet.com\/art-world\/yves-bouvier-may-face-360m-tax-evasion-charge-1899637\">believe<\/a> that Bouvier did not declare the profits stemming from these sales, and that the art dealer is liable for taxes on the full amount. While the investigation is ongoing, the Swiss Federal Tax Administration has <a href=\"https:\/\/www.swissinfo.ch\/eng\/business\/geneva-art-dealer-said-to-owe-chf330-million-in-taxes\/45946474\">confiscated<\/a> an unspecified property of Bouvier\u2019s, reportedly worth CHF 4.5 million, as a pledge.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bouvier\u2019s Singaporean residence not valid<\/h2>\n\n\n\n<p>Yves Bouvier maintains that he has been a Singaporean resident since 2009 and therefore does not owe Swiss taxes on any income he made after that point. Swiss tax authorities <a href=\"https:\/\/news.artnet.com\/art-world\/yves-bouvier-may-face-360m-tax-evasion-charge-1899637\">believe<\/a> that Bouvier\u2019s Singaporean residence is not valid and that he continued to carry out business in Geneva and that, while his two companies were offshore entities, their \u201ceffective administration\u201d was from Switzerland.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fraud charges similar to those dropped in Monaco<\/h2>\n\n\n\n<p>Bouvier is also still under <a href=\"https:\/\/news.artnet.com\/art-world\/yves-bouvier-lawsuit-dismissed-monaco-rybolovlev-1893375\">investigation<\/a> in Switzerland on fraud charges similar to those dropped in Monaco last month. Rybolovlev claims that Bouvier misrepresented his role as an agent to cheat him out of CHF 1 billion, while Bouvier <a href=\"https:\/\/www.nytimes.com\/2020\/07\/08\/arts\/design\/yves-bouvier-art-fraud-monaco.html\">maintains<\/a> that he used legitimate business tactics to ensure that Rybolovlev paid
